Terms and Conditions

These Terms and Conditions (“Terms”) govern all services provided by DeepDev (“we”, “us”, “our”). By requesting a quote, engaging our services, signing an agreement, or paying an invoice, you (“Client”, “you”) agree to these Terms.

If a separate written agreement is signed, that agreement prevails to the extent of any inconsistency.

We provide custom website design and development services, including:

• Custom website design and development (including Next.js-based applications)
• Website updates and maintenance (as agreed)
• E-commerce development (where agreed)
• Hosting assistance (where included in your plan)

All services are provided as described in your written proposal, invoice, or agreement.

All quotes are based on the agreed project scope. Any additional features, functionality, integrations, or pages not expressly included in the original scope may incur additional charges.

We are not required to perform work outside the agreed scope without written approval.

Lump Sum Projects

• A deposit may be required before work begins.
• The remaining balance must be paid before deployment or transfer.
• Work outside scope is billed separately.

Subscription Plans

• A minimum 12-month term applies.
• After the minimum term, services continue month-to-month unless cancelled.
• If cancelled before the minimum term ends, the remaining balance becomes payable.
• Website ownership remains with DeepDev unless agreed otherwise in writing.

• Provide accurate and complete content and materials.
• Ensure you have legal rights to all supplied content.
• Respond to feedback requests within a reasonable timeframe.

Delays caused by the Client may extend delivery timelines.

Client Content

You retain ownership of all content, branding, trademarks, and materials you provide. You grant us a licence to use that content solely to perform the services.

Website Ownership

For lump sum projects, upon full payment, you receive a non-exclusive licence to use the completed website.

For subscription projects, DeepDev retains ownership of the website and source code.

To the maximum extent permitted under Australian law:

• We do not guarantee specific business results, search rankings, or revenue outcomes.
• We are not liable for indirect or consequential damages.
• Our total liability is limited to the amount paid for the relevant service.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the jurisdiction of the courts of Victoria.

We may update these Terms at any time. The updated version will be published on this page with a revised “Last Updated” date.
